Terms of Use
This Privacy Policy describes what we do with your personal data, how we obtain it, who we share it with and how long we process it. We have also described what rights you have and how to contact us if you have any questions about our processing of your personal data.
Newsletter subscription terms and conditions
§ 1. General Provisions
- These Newsletter Subscription Terms and Conditions (hereinafter also referred to as the Terms and Conditions) set forth the rules for providing and using the Newsletter Subscription Service.
- The content and graphic elements of the Newsletter are subject to copyright or other intellectual property rights held by the Service Provider or third parties and are legally protected. By entering into an agreement with the Service Provider for the provision of the Newsletter Service, the Subscriber does not acquire any rights or licenses to the intellectual property contained in the Newsletter.
§ 2. Definitions
- Service Provider — KP Labs Spółka z ograniczoną odpowiedzialnością (a limited liability company) with its registered office in Gliwice, Poland, at Bojkowska 37J, 44-100 Gliwice (KP Labs);
- Newsletter — information sent periodically to the e-mail address provided during registration in the subscriber database; containing informational, promotional, or advertising content (including commercial communications) of the Service Provider or other entities;
- Subscriber — a natural person, legal entity, or legal entity with limited legal capacity that has subscribed to the Newsletter Service;
- Subscription — the service of periodic delivery of the Newsletter;
- Form — an online form available on the Website that enables the Subscriber to order the Newsletter Service;
- GDPR — Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
§ 3. Terms of Use
Before consenting to the Newsletter Subscription Service, the Subscriber must carefully read these Terms and Conditions.
1. The use of the Newsletter Subscription Service is voluntary and is provided free of charge for an indefinite period.
2. The Subscriber is obligated to pay fees to telecommunications service providers for internet access and data transmission (telecommunications operators) in accordance with the price lists and terms of service of such providers.
3. For the purpose of providing the Newsletter Subscription Service, KP Labs collects the e-mail addresses of interested individuals.
4. The rules governing the processing of Subscribers’ data are set out in § 6 of these Terms and Conditions and in the Privacy Policy and Cookies Policy, available via the following link: Privacy Policy.
5. The Newsletter is distributed at predetermined intervals in the form of an e-mail to addresses included in the Subscriber database.
6. To subscribe to and use the Newsletter Service, the Subscriber must complete the Newsletter Signup Form and submit it to the Service Provider by clicking the subscription field within the Form.
7. The Newsletter Subscription begins upon activation of the Subscription.
8. Any person who provides incorrect data when subscribing to the Newsletter, including an e-mail address of a third party without their knowledge and consent, shall bear full liability for any claims made by that third party against KP Labs.
9. The Subscriber lacking legal capacity exercises this right through their statutory representative or legal guardian.
10. The Subscriber has the right to unsubscribe from the Newsletter Service at any time. The Unsubscribe Form is available at the end of the most recent Newsletter.
11. Upon unsubscribing, the Subscription will be fully deactivated.
12. The removal of the Subscriber's e-mail address from the Newsletter database occurs immediately and is confirmed with a notification message.
13. To use the Newsletter Subscription Service, the Subscriber must have a computer with internet access, any web browser, and an active, properly configured e-mail account.
§ 4. Personal Data Protection
- The Data Controller of Subscribers' personal data is KP Labs Sp. z o.o. (hereinafter also referred to as the Data Controller). KP Labs can be contacted in writing at the following address: ul. Bojkowska 37J, 44-100 Gliwice, or via email at: info@kplabs.pl
- The Data Controller has appointed a Data Protection Officer (DPO). The User can contact DPO via e-mail at: adminrodo@kplabs.pl or by post to the correspondence address of KP Labs. The DPO can be contacted regarding all matters related to the processing of personal data, particularly in relation to exercising rights associated with such processing.
- The Data Controller will process personal data for the purposes specified in section 4, which include the provision of the Newsletter Subscription Service, handling Subscribers’ complaints and establishing, pursuing, or defending against potential claims.
- Personal data will be processed for the purpose of providing the Newsletter Subscription Service electronically in accordance with these Terms and Conditions, based on the consent given by the Subscriber (Article 6(1)(a) of the GDPR). Personal data may also be processed based on the Data Controller’s legitimate interest in handling complaints regarding the Newsletter Subscription Service or pursuing/defending claims against the Subscriber (Article 6(1)(f) of the GDPR).
- Recipients of personal data may include:
- entities providing postal services and entities facilitating electronic communication services, if correspondence is necessary;
- entities with which the Data Controller has concluded service agreements in connection with the IT systems used.
- KP Labs does not plan to transfer personal data to recipients in third countries (outside the European Economic Area) or international organizations.
- Personal data will be processed for the period necessary to fulfil the purposes specified in section 4 above, i.e., until the Subscriber unsubscribes from the Newsletter or KP Labs discontinues the Newsletter Subscription Service, as well as for the period necessary to process complaints and until the expiry of any claims related to the processing of personal data in connection with the provided service.
- Individuals whose personal data is processed have the right to request access to their personal data and obtain a copy thereof, the right to rectification, erasure, or restriction of processing, the right to object to the processing of data on grounds relating to their particular situation, and the right to data portability.
- Where processing is based on consent, the Subscriber may withdraw consent at any time, without providing a reason, without affecting the lawfulness of processing carried out based on consent before its withdrawal.
- If a person believes that the processing of their personal data violates legal provisions, they have the right to lodge a complaint with the supervisory authority, for example, the President of the Personal Data Protection Office in Poland.
- Personal data will not be subject to automated decision-making, including profiling.
- Providing personal data is necessary for the provision of the Newsletter Subscription Service or for handling complaints. The Data Subject is not obligated to provide their data; however, failure to do so will prevent the execution of the aforementioned service and the handling of any potential complaints.
§ 5. Liability
The Service Provider shall not be liable for improper performance of the Newsletter Subscription caused by:
- force majeure;
- a failure resulting from the fault of the Subscriber or irregularities in the Subscriber’s computer system;
- the quality of the Subscriber’s internet connection;
- failures of equipment belonging to the Subscriber’s internet providers, electricity suppliers, or telecommunications operators;
- damage caused by actions or omissions of the Subscriber, in particular, for using the services specified in these Terms and Conditions in a manner inconsistent with applicable law or these Terms and Conditions, as well as for damages resulting from providing incomplete or false data;
- content originating from parties other than the Service Provider, in particular, informational, promotional, or advertising content from such parties.
§ 6. Complaint Procedure
1. Complaints may be submitted via email to: info@kplabs.pl
- The complaint should include the e-mail address provided during registration in the Subscriber database and the content of the complaint.
- If the submitted complaint lacks essential details preventing its consideration, the Service Provider may request the Subscriber to supplement the complaint, specifying a deadline of no less than seven (7) days and the scope of the required supplementation, along with a notice that failure to complete the complaint within the specified timeframe will result in the complaint not being considered.
- The Service Provider shall process the complaint and provide a response within seven (7) days.
- The response to the complaint will be sent via email, based on the contact details provided by the complainant in the complaint.
§ 7. Rights of the Service Provider
- The Service Provider has the right to terminate the Newsletter Subscription Agreement with the Subscriber, subject to a seven-day notice period, in the event of ceasing business operations or discontinuing the Newsletter Service.
- The Service Provider may refuse to provide the services specified in these Terms and Conditions if justified by security concerns or in other cases specified in these Terms and Conditions or applicable law.
- The Service Provider reserves the right to:
- expand or modify the software used for the provision of services under these Terms and Conditions;
- change the visual design or layout of the websites used to provide the services specified in these Terms and Conditions;
- expand or modify the forms and scope of service usage without prior notice to Subscribers.
- If the Subscriber violates the law or the provisions of these Terms and Conditions, the Service Provider is entitled to suspend the provision of services specified in these Terms and Conditions. The Service Provider will notify the Subscriber via e-mail of the intention to discontinue the provision of the services specified in these Terms and Conditions. At the same time, the Service Provider will request the Subscriber to cease such activities and remedy the breach or provide relevant explanations within a specified period of no less than three (3) days. Upon ineffective expiration of an indicated term or if the Subscriber provides insufficient or unreliable explanations, the Service Provider may permanently cease provision of the services specified in these Terms and Conditions, of which the Subscriber will be informed.
- The Service Provider is entitled to immediately terminate the provision of services specified in these Terms and Conditions without prior notice to the Subscriber in the following cases:
- withdrawal of consent for the processing of the Subscriber’s personal data by the Service Provider for the purposes specified in these Terms and Conditions;
- withdrawal of consent for the processing of personal data of a legal guardian or representative of a Subscriber lacking legal capacity, for the purposes of representing the Subscriber and making the statements specified in these Terms and Conditions and Forms;
- provision of false personal data by the Subscriber;
- the Subscriber's resignation from the services specified in these Terms and Conditions.
- The Service Provider may, at any time, discontinue the provision of the Newsletter Service, change its subject matter, or modify the frequency of Newsletter distribution
§ 8. Final Provisions
1. The Terms and Conditions of the Newsletter Subscription Service are available at: ……………..
2. The Service Provider reserves the right to amend these Terms and Conditions. The Service Provider shall inform Subscribers about changes by posting a notification on the Website containing a summary of the changes. Additionally, Subscribers will be notified about the amendments (including a summary of the changes) via the Newsletter. Such notification shall occur no later than fourteen (14) calendar days before the amended Terms and Conditions take effect.
3. The amended Terms and Conditions shall come into force on the date specified in the notification, but not earlier than fourteen (14) calendar days after the Subscriber has been informed about the changes. The amended Terms and Conditions will be binding on the Subscriber unless the Subscriber declares their opting out from the Newsletter within fourteen (14) days of receiving the notification about the amendments.
